Carrollton Council OK’s vape shop resolution | Times Georgian

The resolution was put into effect with the purpose of maintaining health, morals, safety, security, peace and general welfare, as the unregulated operation of vape shops is a “threat” in the city, according to city documents.

Proximity restrictions will be established in the general commercial (C-2) zoning district and it will prevent vape shops in the central business and neighborhood commercial zoning districts.

The approval also amended articles one and two of the Unified Development Ordinance, adopted by the council on Sept. 10, 2007. Article one of general provisions defines the use of vape shops for the retail sale of alternative nicotine products or vape juice while article two outlines zoning districts and uses including permissible (P), permissible to subject to supplemental standards (S), special use (SU), and prohibited (blank).

In accordance with the Georgia State Constitution, Article IX, Section II, Paragraph IV states that plans may be adopted and the power of zoning may be exercised. This authorization shall not prohibit the General Assembly from enacting general laws and establishing procedures.
