Lawsuit settlement rejected by Coweta commission | News

City Council members proposed an amended settlement agreement decreasing the mileage the city would maintain to just the portion of Lower Fayetteville Road starting at Kent Drive, extending to the northeast corner of the Lennar property, and specifying that they would authorize Newnan Utilities to provide sewer service to the fire station at the county’s expense.

They also requested confirmation that the county would drop its lawsuit.

After a closed session at their meeting on Tuesday, Coweta County commissioners unanimously rejected the city’s amended settlement.

“I just want to make it publicly known that Station 5 is going in at the LaGrange(Street)-Smokey Road area,” Reidelbach said before the vote. “It will be a brand new station with a brand new (advanced life support ambulance) that is not now supporting the west side of Newnan. (The ambulance now) comes all the way from Station 1. So, this is as much a benefit of the citizens of Newnan to have this fire station located up there.”

The lawsuit, filed by the county on Feb. 22, 2023, asked the court to stop the city from taking action on a proposed annexation of the acreage on Lower Fayetteville Road, west of Newnan Crossing Bypass.

The county objected to the annexation in August 2022, and arbitration was scheduled.

However, one of the county’s chosen arbitrators canceled a week before the arbitration. The county did not select a replacement arbitrator for the panel, and the arbitration never occurred. The county charged…
